What is an SMS marketing disclaimer?

An SMS marketing disclaimer is a legal notice required for text message marketing campaigns in the United States. It informs recipients of the nature of the messages they will receive, that message and data rates may apply, how to opt out (typically by replying STOP), and how to get help (by replying HELP). SMS disclaimers are required under the Telephone Consumer Protection Act (TCPA) and FCC regulations for any business sending automated or bulk text messages.

What does the TCPA require?

The TCPA requires businesses to obtain prior express written consent before sending marketing text messages to consumers. The consent must clearly disclose that the consumer is agreeing to receive recurring automated marketing messages. Every SMS marketing campaign must include clear opt-out instructions (STOP to cancel), and businesses must immediately honor opt-out requests. Violations can result in statutory damages of $500–$1,500 per text message.

Where should SMS disclaimers appear?

SMS disclaimers must appear wherever you collect phone numbers for marketing — opt-in forms, checkout pages, landing pages, and sign-up screens. The disclosure must be visible and proximate to the consent checkbox or button, not buried in fine print. For each individual text message campaign, include at minimum: message frequency notice, opt-out instructions (STOP), help instructions (HELP), and a message/data rates notice.
