What is an affiliate disclaimer?
An affiliate disclaimer is a disclosure statement informing readers that a content creator may earn a commission if they purchase through links on the page. The FTC (Federal Trade Commission) requires these disclosures under 16 CFR § 255 whenever there is a "material connection" between the publisher and a brand — including paid partnerships, gifted products, or commission-based affiliate programs like Amazon Associates, ShareASale, or Commission Junction.
Is an affiliate disclaimer legally required?
Yes, in the United States. The FTC requires affiliate disclosures for any content where the creator has a financial relationship with the brand being promoted. Other countries have similar requirements: the UK's CAP Code, the EU's Unfair Commercial Practices Directive, and Canada's Competition Act all mandate disclosure of paid relationships. Failure to comply can result in FTC enforcement action, fines, and significant reputational damage.
Where should an affiliate disclaimer be placed?
The FTC requires affiliate disclosures to be "clear and conspicuous" — meaning placed where readers will actually see them before clicking any affiliate link. Best practice is to place the disclosure at the top of every page or post containing affiliate links. A single disclosure page or a notice buried in your footer is not sufficient. For social media posts, disclosures must appear at the beginning of the caption — not hidden in hashtags.
